APPLICABILITY OF TERMS AND CONDITIONS
The following terms and conditions govern the direct sale of home appliances and related products by ALLIED COMPANY FOR TRADING AND INDUSTRY ( ACTI EGYPT ) to customers in the Arab Republic of Egypt ("Customer"). By using this web site and/or accepting delivery of products ordered from ACTI EGYPT , Customer agrees to be bound by and accepts these terms and conditions. THESE TERMS AND CONDITIONS SHALL APPLY TO ANY SALE DIRECTLY FROM ACTIEGYPT TO CUSTOMER, UNLESS CUSTOMER HAS SIGNED A SEPARATE PURCHASE AGREEMENT WITH ACTIEGYPT. Products described on this web site are only available to residents of the Arab Republic of Egypt.
ACTI EGYPT reserves the right to change these terms and conditions without prior written notice at any time, at its sole discretion; the most current version will always be posted on this site. These terms and conditions may not be supplemented, modified or altered by the use of any other documents(s). Any attempt to alter, supplement, modify or amend these terms and conditions will be null and void unless agreed to in writing by ACTI EGYPT.
1. Internal Use
Customer agrees and represents that it is buying products from ACTI EGYPT for its own internal use and not for resale.
2. Payment Terms; Orders; Quotations
Payment can be made by bank transfer, cash on delivery or by credit card must be received by ACTI EGYPT prior to ACTI EGYPT‘s acceptance of Customer's order, unless some other pre-arranged method of payment has been accepted by ACTI EGYPT. If Customer has obtained credit through a ACTI EGYPT sponsored financial program, payment terms, including interest and late charges, will be based on the terms of the financing agreement.
Orders are not binding on ACTI EGYPT unless accepted by ACTI EGYPT. Acceptance of an order occurs when product is shipped, received & paid for by buyer. Acknowledgment of receipt of an order does not constitute acceptance of the order by ACTI EGYPT.
Any quotation provided by ACTI EGYPT will be valid for the duration stated in the quotation. If no duration is stated, such quotation is valid for 48 hours from date of quotation.
3. Prices; Shipping and Handling Charges; Taxes; Interest
Prices and configurations shown are subject to change without prior notice at any time before acceptance of Customer's order. ACTI EGYPT is not liable for typographical errors or omissions and mistakes on quotations or prices.
Prices shown do not include charges for shipping and handling or for applicable sales/use taxes. Customer is solely responsible for applicable shipping and handling charges and taxes. Unless Customer provides ACTI EGYPT with a valid government or nonprofit tax exemption certificate, taxes will be charged for orders shipped to states in which CS&I is obligated to collect and report such sales
Title and risk of loss shall pass to Customer upon shipment from ACTI EGYPT show rooms.
5. Limited Warranty
ACTI EGYPT provides a 2 years warranty which is posted on the cartoons of all our products.
To activate the 2 years warranty:
Contact the call center with the invoice from the merchandiser you bought the item from.
They will take some data and activate the warranty from the date you called.
Within the 1st 2 years ,If there is any after sales service needed the consumer will have to go to any of our 45 service centers covering Egypt with the invoice and the warranty card attached on the cartoon and the device will be maintained for free (as long as it’s not damaged because of bad use from the customer).
After the 2 years warranty if any after sales service needed the consumer can go to any of our 45 after sales service centers.
6. Limitation of Liability
FOR ANY BREACH OF THESE TERMS AND CONDITIONS, ACTI EGYPT’s MAXIMUM LIABILITY SHALL NOT EXCEED THE TOTAL PRICE PAID BY CUSTOMER FOR THE PRODUCTS ORDERED BY CUSTOMER.
IN NO EVENT SHALL ACTI EGYPT BE LIABLE TO CUSTOMER OR ANY THIRD PARTY FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOST PROFITS, OR THE LIKE), OR PUNITIVE DAMAGES, WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE AND PRODUCT LIABILITY) OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY A THIRD PARTY.
7. Binding Arbitration; Governing Law
Customer and ACTI EGYPT acknowledge and agree that any claim, dispute, or controversy between Customer and ACTI EGYPT arising from or relating to (i) these terms and conditions of sale, including the validity of this binding arbitration provision; or (ii) the purchase or use of any product or service from ACTI EGYPT each, a "Dispute") shall be resolved through arbitration.
8. Shipment and Availability
ACTI EGYPT can only ship to Customer addresses in the Arab Republic of Egypt.
Any delivery or shipment date provided is a good faith estimate. Customer acknowledges that product availability may be limited, and particular products may not be available for immediate delivery.
Generally all orders will be shipped within 24 hours after payment is cleared.
All orders will be shipped USPS First Class Mail or Priority Mail depending on weight.
You will get an email with tracking information the same day when your order is processed, so you can easily track your items.
9. Export Control
Customer acknowledges that products and technical data purchased or received under these terms and conditions may be subject to Arab Republic of Egypt export control laws and regulations. Customer will not ship any products outside the Arab Republic of Egypt without proper authorization. Customer will defend and hold ACTI EGYPT harmless against all claims, damages or liability resulting from breach of the foregoing.
10. Return Policies:
All of the items sold are 100% authentic and will be received exactly as described
Please read the description prior to purchasing the item and ask all questions before purchasing the item.
As part of our commitment to customer service, we offer a fair return policy. It is important to note that we do not accept returns on any Used, Tested or Opened Products
All product are new and unused, some boxes might have scratches and box damage, Box only and doesn't Effect the product itself in anyway.
As long as your product is brand new in the package, we will accept returns within 30 days after it has been received by you.
Before leaving negative or neutral feedback, please contact us on any of our channels with any questions/concerns/problems and I will be more than happy to work it out with you towards your complete satisfaction.
12. Possible System Failure
Order entry systems have been designed to provide an efficient and dependable method for entering orders. Commercial internet service providers are not 100% reliable and a failure by one or more of these providers may affect internet based order entry. The customer acknowledges that the order entry system is a mechanical system and as such may be subject to failure beyond the control of ACTI EGYPT.
13. No Assignment
Customer may not assign its rights or obligations under these terms and conditions without the express written consent of ACTI EGYPT.
If any of these terms and conditions are held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining terms and conditions shall not in any way be affected or impaired thereby.
15. Entire Agreement
These terms of sale constitute the entire and sole agreement between ACTI EGYPT and Customer and supersedes all prior agreements, representations, warranties and understandings with respect to the subject matter of these terms.
Cancelling an Order
You can cancel your order/item only before it enters the shipping phase. The option to cancel an order/item will cease to appear when the shipment has entered the shipping phase.
To cancel an item/order:
1. Log in to your actiegypt account using your registered email address and password.
2. Click on My Orders.
3. Locate the item you wish to cancel.
4. Click on I No Longer Want This Item against the item you wish to cancel.
Cancel an item
5. Select the desired reason for cancellation of the order/item from drop-down menu.
6. Click on Complete Cancellation to complete the cancellation request.
Note: For purchases made with a credit card, the amount will be refunded to the same card within 5 to 7 working days after successful cancellation of the order.
